IMPORTANT - PLEASE READ CAREFULLY AND RETAIN THIS DEPOSIT ACCOUNT AGREEMENT FOR YOUR RECORDS.

Deposit Agreement and Disclosures

Please read this carefully and retain it for future reference. This Deposit Account Agreement (the “Agreement”) is revised periodically, so it may include changes from earlier versions.

This Agreement governs the demand deposit account (“Checking Account”) available from Stride Bank, N.A., member of the Federal Deposit Insurance Corporation (“FDIC”) (the “Bank” or “Issuer”) on behalf of Chime Financial, Inc. the program partner responsible for managing the Checking Account (“Chime”). “We,” “our,” and “us” refer to the Bank, our successors, affiliates, or assignees. “You,” “your,” “Chime member,” and “member” refer to the owner of the Checking Account.

By providing a written or electronic signature on a signature card or opening, or continuing to hold an account with us, you agree to the most recent version of this Agreement, which is available to you at chime.com, or by calling us at the number listed on the last page of this Agreement. You agree to appoint Stride Bank, N.A. as your agent to pool the funds in your Checking Account with funds from the holders of other Checking Accounts and to then deposit those funds in one or more FDIC insured banks, and to obtain your funds from the pooled funds account(s) in order to transfer your funds as you may direct.

NOTICE: THIS AGREEMENT REQUIRES ALL DISPUTES TO BE RESOLVED BY WAY OF BINDING ARBITRATION. THE TERMS OF THE ARBITRATION CLAUSE APPEAR AT THE END OF SECTION II OF THIS AGREEMENT.

CELLULAR PHONE CONTACT POLICY

By providing us with a telephone number for a cellular phone or other wireless device, including a number that you later connect to a cellular device, you are expressly consenting to receiving communications-including but not limited to prerecorded or artificial voice message calls, text messages, and calls made by an automatic telephone dialing system-from us, Chime, our affiliates, Chime’s affiliates, our agents, and Chime’s agents at that number. This express consent applies to each such telephone number that you provide to us now or in the future and permits such calls for non-marketing purposes. Calls and messages may incur access fees from your cellular provider.

Our Agreement

You may open the Checking Account at the Chime Website (the “Website”) by visiting chime.com or by using the Chime mobile banking application (the “Chime Mobile App”). The Checking Account is not designed for business use, and we reserve the right to close the Checking Account if we determine it is being used for business purposes. We reserve the right to refuse to process any transaction(s) that we believe may violate the terms of this Agreement.

You are responsible and liable for all activity you have authorized on your Checking Account unless otherwise noted below.

Business Days

Our business days are Monday through Friday, excluding federal holidays. Any references to “days” found in this Agreement are calendar days unless indicated otherwise.

 

Account Basics

  1. Chime Checking Account Eligibility
    The Checking Account is available to citizens and permanent residents of the fifty (50) United States (“U.S.”) and the District of Columbia who are at least 18 years of age with a valid Social Security number. You must agree to accept electronic, rather than paper statements. This means:

    1. you must keep us informed of your current valid email address; and
    2. you must agree to accept electronic delivery of all account communications (such as end-of-year tax forms and electronic statements).

    We may use information from third parties to help us determine if we should open your Checking Account.

  2. Opening an Account
    IMPORTANT INFORMATION ABOUT PROCEDURES FOR OPENING A NEW ACCOUNT.
    To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an Account. What this means for you: When you open an Account, we will ask for your name, address, date of birth, and other non-public personal information that will allow us to identify you. We may also ask to see a copy of your driver’s license or other identifying documents.
  3. The Checking Account
    The Checking Account consists of the online transaction demand deposit account used to make payments and transfers to third parties online or through the use of a Chime Visa
    ® Debit Card (“Card”) that is automatically issued with the Account. The Chime Checking Account is a personal, checkless account. You may not issue paper checks with the Chime Checking Account unless you use Chime Checkbook. We will not issue you a personal checkbook to write checks from your Account. The only paper checks allowed for the Checking Account are those issued through Chime Checkbook. If you attempt to obtain and use a personal checkbook, the check will be rejected. For more information about Chime Checkbook, see section E.1 below.


    Members have the option to open a linked Chime Savings Account (“Chime Savings” or “Savings Account”) which is an interest-bearing savings account. Separate terms and conditions apply to Chime Savings: see chime.com for additional information.

    If you have opened a Chime Credit Builder credit card (the “Credit Card”) account and a secured deposit account related to the Credit Card account (the “Secured Deposit Account” or “Secured Account”), you have the option to select your Checking Account or your Secured Deposit Account as your “default” account for most incoming deposits and transfers. Deposits and transfers will land in your Checking Account first, regardless of your default selection. However, if you choose your Secured Deposit Account as your default account, you authorize automatic transfer of most incoming deposits and transfers to your Secured Deposit Account when funds are received. Funds received in the Checking Account are subject to outstanding balances such as SpotMe and MyPay or other applicable obligations set forth in this Agreement. See Section C below for more information about the deposits and transfers that can be automatically transferred from your Checking Account to your Secured Deposit Account.

    Selecting your Secured Deposit Account as your default account and authorizing the automatic transfers from your Checking Account to your Secured Deposit Account a does not limit use of your Checking Account or your Checking Account debit card.

  4. Account Titling and Ownership
    The Checking Account may only be owned and titled in the name of one person who may deposit, transfer, or withdraw funds. The Checking Account cannot be owned or titled jointly, by an organization, as Payable on Death (“POD”) or “In Trust For” (“ITF”).
  5. Death or Incapacitation
    You or your appointed party, designee, or appointed individual agree to notify us promptly if you die or become legally incapacitated. We will continue to accept deposits and process transaction instructions into and from your Checking Account until we are: (a) notified of your death or adjudication of incompetency and (b) have a reasonable opportunity to act. You agree that, even if we have knowledge of your death we may pay or process transactions on your Checking Account on or before the date of death for up to ten (10) days after that date unless ordered to stop payment by someone claiming interest in the Checking Account. We may require additional documentation to confirm any claims made on the Checking Account.
  6. Power of Attorney
    You may appoint another individual as attorney-in-fact for your Checking Account. The account owner and person executing the power of attorney is known as the “Principal.” The person granted the power of attorney for the Principal is known as the “Agent.” You should notify us in advance if you plan to create a power of attorney involving your Checking Account. We generally will accept a Uniform Statutory Form Power of Attorney that complies with state law. We may require the Agent to sign an affidavit stating that the power of attorney presented to us is a true copy and that, to the best of the Agent’s knowledge, the Principal continues to be alive and competent and that the relevant powers of the Agent have not been amended or terminated. The Principal is responsible to provide us with information if an affidavit presented to us is untrue or misleading or if Agent exceeds the authority granted by the Principal in the power of attorney. We may refuse to accept any forms of powers of attorney, however, with or without cause. We may act on the instructions of an attorney-in-fact whether or not the attorney-in-fact relationship is noted in the instruction (e.g., on any check signed by the attorney-in-fact). You can revoke your power of attorney by sending a written notice to us at any time. The power of attorney will continue in force until a) we receive written revocation from the Principal; b) we receive written notification of the Principal’s death; or c) we receive written notification of the death or incapacity of the Agent. We assume no duty to monitor the actions of your attorney-in-fact to ensure that he or she acts for your benefit.
  7. Our Relationship With You
    This Agreement does not create a fiduciary, quasi fiduciary or other special relationship between you and us. We owe you a duty of ordinary care. There are no third-party beneficiaries to this agreement.
  8. Privacy Policy
    Our privacy policy is available at chime.com/policies and is considered part of this Agreement.

Automatic Transfers

  1. Default account selection and automatic transfer authorization
    If you have a Credit Builder credit card and Secured Deposit Account, you have the option to select a default account to receive most of your incoming deposits and transfers. To be eligible to select your Secured Deposit Account as your default account, you must have an open a Checking Account, Credit Card Account, and Secured Deposit Account, each in good standing. If you set your Secured Deposit Account as your default account, funds will first land in your Checking Account before being automatically transferred to your Secured Deposit Account. Before they are transferred, funds will be subject to any outstanding balances you may have, including SpotMe, MyPay, or a negative Checking Account balance.

    By selecting your Secured Deposit Account as your default account, you authorize us to transfer incoming Eligible Deposits (defined below) to your Checking Account; and you acknowledge that funds will be subject to the security interest that you granted to us in the Application Disclosure and Secured Account Agreement to secure Credit Builder credit card payment obligations.

    Selecting your Secured Deposit Account as your default account does not limit use of your Checking Account or your debit card, but you should monitor your Checking Account to ensure you have funds to cover any Checking Account transactions you make, such as bill payments.Any related transactions, including automatic transfers between these accounts, will be governed by the Chime Credit Card Agreement and the Application Disclosure and Secured Account Agreement, in addition to this Agreement.

    Choosing your Secured Deposit Account as your default account requires your agreement to the automatic transfers authorizations in Sections 2 and 3 below and will have the effect of concentrating your funds on deposit in your Secured Deposit Account, rather than your Checking Account.

    At any time, through the Chime Mobile App, you can change your default account selection. If you change your default account from your Secured Deposit Account to your Checking Account, you terminate your authorization to transfer funds to your Secured Deposit Account automatically.

  2. Default Account Automatic transfers Eligible Deposits; Timing and amount of balances; Payment of obligations
    (a) Your Authorization – By selecting your Secured Deposit Account as your default account in the Chime App, you expressly authorize us to make automatic transfers of funds in the amount of each Eligible Deposit (defined below) from your Checking Account to the Secured Deposit Account, at the time of the Eligible Deposit. If an automatic transfer made pursuant to this authorization is an inter-bank transfer between Chime Bank Partners (for example, a transfer from a Bancorp Checking Account to the Stride Secured Deposit Account), your authorization and this inter-bank transfer will also be subject to the Electronic Funds Transfer Disclosure and Special Terms and Conditions Section of this Agreement as set forth in Section II below.

    (b) Eligible Deposits -Not all funds received in your Checking Account are subject to the authorization above and will not be transferred automatically. We will automatically make transfers from your Chime Checking Account to your Secured Deposit Account pursuant to your authorization above each time that we identify that you have received the following “Eligible Deposits” to your Checking Account: (1) a payroll deposit made by your employer, or other payor, that is coded as a payroll transfer of funds (payroll deposits and the amount to be automatically transferred are subject to outstanding balances such as the optional MyPay and SpotMe services); (2) a government benefit deposit; (3) any deposit or transfer of funds made by ACH through the Automated Clearing House (ACH) network, including Recurring Transfers (defined below); (4) cash; (5) mobile check deposits; (6) Pay Anyone transfers,; (7) MyPay transfers; (8) instant transfers you may have initiated or receive; and (9) Visa® money transfers made directly to your Checking Account.

    (c) Specific Exclusions – Eligible Deposits do not include the following: loans; referral bonuses, Top of Wallet incentives, manual bonus adjustment from agents, refunds, chargebacks, rewards, reimbursements and microdeposits,

    (d) Repayment obligations – Each automatic transfer from the Checking Account to the Secured Deposit Account will be promptly made upon each Eligible Deposit into your Checking Account. The amount of each automatic transfer will be the amount of each Eligible Deposit less any negative Checking Account balance or outstanding balances such as SpotMe or MyPay. For the avoidance of doubt, when a negative Checking Account balance exists, you agree that any Eligible Deposit made to your Checking Account can be used by us to bring a negative Checking Account to $0.00 and according to the terms and conditions of any optional deposit account service you have elected.

  3. Recurring Transfers from your external bank account
    (a) You can schedule recurring transfers from your linked external bank account for deposit into your Secured Deposit Account (the “Recurring Transfers”). These Recurring Transfers will first land in your Checking Account and be moved automatically to your Secured Deposit Account. When you schedule a Recurring Transfer, you authorize us to debit your external bank account in the amount and at the frequency you select in the Chime app. Further, when you schedule a Recurring Transfer to your Secured Deposit Account, you expressly authorize us to make automatic transfers of those funds from your Checking Account to the Secured Deposit Account. You acknowledge and agree that these Recurring Transfers are Eligible Deposits subject to the terms in Section 2 above. Subject to Section 2 (d) above, these automatic transfers from your Checking Account to the Secured Deposit Account will be for the full amount of the Recurring Transfer and will take place at the time of the Recurring Transfer.

    (b) Recurring Transfers to your Checking Account are subject to the terms and conditions governing your external account. If an automatic transfer made pursuant to this authorization from your Checking Account to your Secured Deposit Account is an inter-bank transfer between Chime Bank Partners (for example, a transfer from a Bancorp Checking Account to the Stride Secured deposit Account), your authorization and this inter-bank transfer will also be subject to the Electronic Funds Transfer Disclosure and Special Terms and Conditions Section of this Agreement as set forth in Section II below.

    (c) When you link an external account and set up Recurring Transfers in the Chime app, you certify, that you are the owner of the external bank account from which you are making those transfers.

  4. Automatic transfers from your Secured Deposit Account to your Checking Account
    Your Authorization – You expressly authorize us to make transfers of available, funds from your Secured Deposit Account to your Checking Account each time you initiate a transfer “from Credit Builder” in the relevant user experience in the Chime app. The available transfers “from Credit Builder” include the following: ACH, instant transfers and Pay Anyone Transfers.This authorization is related to your enrollment in and use of the Credit Card and Secured Deposit Account, as further described in the agreements for those two products. If an automatic transfer made pursuant to this authorization is an inter-bank transfer between Chime Bank Partners (for example, a transfer from a Stride Secured Deposit Account to a Bancorp Checking Account), your authorization and this inter-bank transfer will also be subject to the Electronic Funds Transfer Disclosure and Special Terms and Conditions Section of this Agreement as set forth in Section II below.
  5. Automatic Transfer of funds to SpotMe Overdraft Line of Credit Account for the payoff of a SpotMe Overdraft Line of Credit balance (if any) upon closure of your Credit Card
    Your authorization – You agree that by enrolling in the optional SpotMe Overdraft Line of Credit as associated with the Credit Card, you agree and authorize Chime to automatically transfer available funds from your Chime Checking Account to your SpotMe Overdraft Line of Credit account to pay in full the SpotMe for Credit balance without first being provided with a billing statement if you have balance due on your SpotMe Overdraft Line of Credit Account, and you have closed your Credit Card Account and/or Secured Deposit Account. These automatic transfers from your Checking Account to the SpotMe Overdraft Line of Credit Account will be for the full amount of the SpotMe Overdraft Line of Credit balance from any available funds in your Checking Account. This authorization is related to your enrollment in and use of the Credit Card and the SpotMe Overdraft Line of Credit, as further described in the SpotMe Overdraft Line of Credit Agreement. The transfer may be subject to the Electronic Funds Transfer Disclosure and Special Terms and Conditions Section of this Agreement as set forth in Section II below if it is an inter-bank transfer.
  6. Authorization to repay a negative balance in Checking Account from the Secured Deposit Account
    Your authorization – If you hold a Credit Card account and an associated Stride Secured Deposit Account, and as further set forth in your Application Disclosure and Secured Account Agreement and a Bancorp Checking Account, if your Checking Account balance becomes negative, you authorize us to immediately transfer available funds in your Secured Deposit Account to your Checking Account in the amount of the negative balance. These transfers will be subject to the Electronic Funds Transfer Disclosure and Special Terms and Conditions Section of this Agreement as set forth in Section II below.
  7. Transfers exceeding deposit limit in Secured Deposit Account
    If an automatic transfer would cause the balance of your Secured Deposit Account to exceed the Maximum Balance as defined in the Secured Deposit Account Agreement, we will transfer only the amount of those funds that would not exceed the Maximum Balance.

General Rules Governing Deposit Accounts

You may not grant, transfer or assign the Checking Account or your obligations under this Agreement. The Bank may pool your funds, together with funds from other Cardholders and to deposit those funds at one or more FDIC insured banks and to obtain your funds from the pooled funds account(s) in order to transfer your funds as you may direct. The Bank may also transfer or assign its rights under this Agreement at any time and without providing prior notices to you of the assignment. Use of the Checking Account is subject to all applicable laws, rules, regulations, and customs of any clearinghouse or other association involved in transactions. We do not waive our rights by delaying or failing to exercise them at any time. If any provision of this Agreement shall be determined to be invalid or unenforceable under any rule, law, or regulation of any governmental agency, local, state, or federal, the validity or enforceability of any other provision of this Agreement shall not be affected. This Agreement will be governed by the laws of the State of Oklahoma except to the extent governed by federal law.

    *DIRECT DEPOSITS OR CREDITS USING A DEBIT CARD FROM AN OUTSIDE FINANCIAL INSTITUTION: The recipient’s name on any such deposits we receive must match the name of the Chime Accountholder. Any such deposits received in a name other than the name registered to the Checking Account will be returned to the originator. Deposits using an external debit card from an outside financial institution may be available within minutes of a successful transaction, however there may be times when such transactions are delayed due to network timing or other factors. These transactions are final and nonrefundable.

    ** THIRD PARTY MONEY TRANSFER services used to deposit funds to your Checking Account may impose their own fees, per transaction, daily, weekly or monthly limits on the frequency or amount of cash you may deposit to the Checking Account.

    *** Members may be eligible for higher transfer limits based on Checking Account history, at our sole discretion. New Accounts will be limited to a single transfer.

    We may change these limits with notice to you. To determine the current limits that apply to you, you can access them under the settings section of the Chime Mobile App, contact Member Services by calling 844-244-6363 or ask the Chime Chatbot within the Chime Mobile App

    IMPORTANT: If your Checking Account number changes you must immediately notify your employer or any other payors. You must provide them with the new Checking Account number to ensure that your direct deposit activity continues uninterrupted.

    The above may be unavailable or delayed from time to time due to eligibility requirements, scheduled maintenance, changes to our services, unforeseen circumstances, or outages. Chime will give you reasonable notice if your access to feature changes or is no longer available to you.

    You acknowledge that your participation in the automatic transfers of funds from the Checking Account to the Secured Deposit Account will result in an initial deposit to the Checking Account with an automatic transfer to the Secured Deposit Account for all Eligible Deposits in the amount of the Eligible Deposit less any outstanding deposit account service obligations or negative balance repayment as set forth above.

  2. No Cash, Paper Checks or Foreign Currency
    We are not liable for any deposits, including cash, lost in the mail, lost in transit, or not received by us.

    • Cash – We do not accept deposits made in cash. If you mail a cash deposit, the cash will be sent back to the address we have for you on file.
    • Paper Checks – Personal checks, cashier’s checks, and money orders may not be deposited by mail. All checks and money orders sent to us for deposit will be returned unless the full amount may be applied towards a negative balance, in which case the check or money order may or may not be deposited to the Account at our discretion.
    • Foreign Currency – We do not accept deposits in foreign currency. Any deposits received in foreign currency, cash or check, will be sent back to the address we have for you on file.
  3. Funds Availability
    Please refer to Section IV labeled “MOBILE CHECK DEPOSIT”, Section 20 “Mobile Deposit Funds Availability”, and Section VI labeled, “GENERAL FUNDS AVAILABILITY” for additional information.
  4. Preauthorized Transfers & Direct Deposit
    Your Checking Account number and bank routing number can be used for preauthorized direct debits (“ACH Debits”) from merchants, Internet service or other utility service providers (“Merchants”). They may also be used for the purpose of initiating direct deposits to your Checking Account (with such direct deposits automatically transferred from your Checking Account to your Secured Deposit Account, if you have set your default account as your Secured Deposit Account and participate in the automatic transfers as set forth in Section C above). Preauthorized ACH Debit transfers will be processed under the Operating Rules of the National Automated Clearing House Association (“NACHA”) and you agree to comply with the NACHA rules. Detailed information regarding preauthorized transfers is available in Section II, labeled “ELECTRONIC FUNDS TRANSFER DISCLOSURE AND SPECIAL TERMS AND CONDITIONS.”
    NOTE: The recipient’s name on any direct deposit(s) we receive must match the name of the Chime Accountholder. Any direct deposits received in a name other than the name registered to the Checking Account will be returned to the originator. IMPORTANT: If your Checking Account number changes you must immediately notify the Merchants. You must provide them with the new Checking Account number to ensure that the ACH Debit activity continues uninterrupted.
  5. Problems That Could Occur with Deposits
    Overpayments and Reversals. If funds are deposited or transferred into your Checking Account by mistake or otherwise, you agree that we may correct the situation by deducting the amount of the deposit from your Checking Account without prior notice to you. If there are not enough funds in your Checking Account at that time, your Checking Account could become overdrawn. See Section C (2)(d) and C(6) above and the “No Overdrafts” and “Right to Set Off” sections below, as well as the “SpotMe” section below, for more information about what could occur if your Checking Account has a negative balance.
  6. No Overdrafts, SpotMe
    You are not permitted to overdraw your Checking Account, unless you are eligible for and enrolled in SpotMe. If the available balance in your Checking Account is not sufficient to cover any payment or withdrawal you have authorized, we can refuse to process the payment or withdrawal. Even if we’ve paid overdraft items before, we are not required to do it in the future. It’s your responsibility to avoid overdrawing your account.

    Below we describe, generally, how we post transactions to your Chime Account. Please note that this process may change from time to time, without prior notice to you. Our order of posting depends on a number of factors, including when a transaction occurs, whether it has already been approved by us or has become final, the order in which it is presented, the amount, system availability, potential risk of loss to the Bank, and the type of transaction in question, among other variables. If you are participating in the automatic transfers as set forth in Section C above, Eligible Deposits posted to your Account will be transferred to your Secured Deposit Account.

    First, we credit your Checking Account for deposits received before the cutoff time. Then, we process withdrawals / payments we have previously authorized and cannot return unpaid, such as Card purchases, ATM withdrawals, Pay Anyone, and Chime Checkbook transactions. If we receive more than one of these transactions for payment from your Checking Account, we will generally sort and pay them based on the date and time you conducted the transactions. For Card transactions, we will use the date the transaction is received for payment from your account. For some transactions, such as Chime Checkbook transactions, the time may be assigned by our systems and may vary from the time you initiated it. Multiple transactions that have the same time will be sorted and paid from lowest to highest dollar amount. We always reserve the right to post transactions that are payable to us first, and we may post any transaction earlier or later in the process than indicated. As such, if you want to avoid an overdraft or the possibility of a rejected transaction, you should take steps to ensure that your account has sufficient funds to cover each of your transactions and any fees.

    If your Checking Account balance becomes negative for any reason, you must make a deposit immediately to cover the negative balance. We may report you to consumer reporting agencies, close your account, or both. This could affect your ability to open accounts with us or other banks in the future. If your Checking Account has a negative balance and you have another account with us, we reserve the right to exercise our right in Section 5b above and our right to set off. See the “Right to Set Off” section below for details. If your Checking Account has a negative balance for sixty (60) calendar days or more, it will be closed. You agree to pay all costs and expenses we incur in collecting overdrawn funds. We may still pursue collection of the amount you owe (including suing you) after it is charged off. Chime and / or the Bank reserve the right to close your Chime Account and any other Chime-branded Account(s) you have opened if you overdraw your Checking Account in violation of these terms or the Terms and Conditions of SpotMe (see below).

    SpotMe

    For Chime members who are eligible for and enrolled in SpotMe, we will approve debit card purchases that result in a negative balance on your Chime Checking Account up to a specified amount, until your next direct deposit or other deposit or credit arrives. To be eligible, you must:

    1. be 18 years of age or older;
    2. have a Chime Checking Account in good standing;
    3. have received a single deposit of $200 or more in qualifying direct deposits into your Chime Checking Account over the preceding 34- day period;
    4. have an Apple iOS or Android smartphone with a data plan; and
    5. meet any other requirement which Chime may impose pursuant to the Chime SpotMe Terms & Conditions.

  7. Right to Set Off
    If your Checking Account balance becomes and remains negative for fifteen (15) days, we can use the funds in any of your accounts to repay the amount owed on the negative balance Checking Account. This means, we have the right to set-off any liability, direct or contingent, past, present or future that you owe against any account you have with us. Further, you grant us a lien on and security interest in the funds on deposit in each of your account(s) as security for all of your liabilities and obligations to us, now or in the future. We do not have to give you any prior notice to apply the funds. You expressly agree that our rights extend to any electronically deposited federal or state benefit payments (including Social Security benefits). If you don’t want your benefits applied in this way, you may change your direct deposit instructions at any time with the person or organization paying the benefits. If any federal benefits or other payments are deposited to your account after you become ineligible to receive them, we may set off against any of your accounts to recover the payments if we’re obligated to return funds to the payor. We will notify you if we have exercised our right to set off. This provision shall not apply to negative balances to the extent they are caused by the authorized use of SpotMe.
  8. Legal Processes Affecting Accounts
    If legal action such as a garnishment, levy or other state of federal investigation or legal process (“Legal Process”) is brought against your Checking Account, we may refuse to permit (or may limit) withdrawals or transfers from your Checking Account until the Legal Process is satisfied or dismissed. Regardless of the terms of such garnishment, levy or other state or federal process, we have first claim to any and all funds in your Checking Account. We will not contest on your behalf any such Legal Process and may take action to comply with such Legal Process as we determine to be appropriate in the circumstances without liability to you, even if any funds we may be required to pay out leaves insufficient funds to pay a transaction that you have authorized. Payment is made after satisfying any fees, charges or other debts owed to us. You agree that we may honor legal process that is served personally, by mail, email or facsimile transmission at any of our offices (including locations other than where the funds, records or property sought is held), even if the law requires personal delivery at the office where your account or records are maintained. You agree that you are responsible for any expenses, including legal expenses and fees we incur due to any Legal Process on your Checking Account. We may charge these expenses to your Checking Account. You will indemnify us for any losses if we do this.
  9. Account Holds, Suspensions, Restrictions and Closures
    Chime and/or Bank may suspend, freeze, restrict, or close your Checking Account for any reason with or without notice. Such reasons include, but are not limited to:

    1. If we, at any time, believe a member is using the Checking Account and/or associated Chime Visa® Debit Card for fraudulent or illegal purposes, or such member otherwise presents an undue risk to Chime and/or the Bank as determined, in our sole discretion.
    2. Your use conflicts with any federal, state or local law, rule or regulation, including federal foreign asset control and sanction rules and anti-money-laundering rules, or with our policies adopted to assure that we comply with those laws, rules or regulations.
    3. We receive a court order or other Legal Process request to suspend or close your account.
    4. Your non-fraudulent actions nonetheless violate any part of this Agreement.
    5. If Chime and/or Bank suspends, freezes, restricts or closes any of your other accounts held by Bank and/or held by another Chime partner bank.

    If our monitoring of the Checking Account detects any such activity, the Account funds will be subject to a hold pending review of the activity by the Bank and/or Chime. The Bank and/or Chime may require you and other parties to the activity to produce documents and/or other materials evidencing the validity of the activity. Funds on deposit in any Account are subject to hold at the Bank’s discretion until the source of such funds and/or the activity is properly verified. The Bank and/or Chime also may temporarily or permanently reduce your limits on deposits to, or withdrawals or transfers from, your account without prior notice to you unless prior notice is required by applicable law, rule, or regulation.

  10. Amendment and Cancellation
    We may amend or change the terms and conditions of this Agreement at any time by posting the amended Agreement on chime.com, and any such amendment shall be effective upon such posting to that Website. The current Agreement is available at chime.com. You will be notified of any change in the manner provided by applicable law prior to the effective date of the change. However, if the change is made for security purposes, we can implement such change without prior notice. We may cancel or suspend your Checking Account or this Agreement at any time.

    You may cancel this Agreement by calling 1-844-244-6363 to close your Checking Account. Your termination of this Agreement will not affect any of our rights or your obligations arising under this Agreement prior to termination. If your Checking Account is cancelled, closed or terminated for any reason, you may be eligible to receive the unused balance, which will be returned to you via check sent to the mailing address we have in our records. For security purposes, you may be required to supply identification and address verification documentation prior to issuing a refund check. Allow fourteen (14) days for processing of the refund check. Your check will be mailed to you to the address on file after it is processed. In the event the program is cancelled, closed, or terminated, we will send you prior notice, in accordance with applicable law, rule, or regulation. Specific information and instructions, including how to receive any remaining Checking Account balance, will be in the notice. We reserve the right to refuse to return any unused balance amount less than $1.00 unless required by applicable law, rule, or regulation.
  11. Account Dormancy and Escheatment
    An account that is inactive for a period of time may be considered dormant and is subject to escheatment. We may transfer (escheat) your property to the appropriate state if no activity occurs in the account or you fail to communicate with us regarding your account within the time period specified by state law. We may consider an account dormant even if you maintain another active account with us. Each state has varying laws as to when an account is subject to escheatment and we may be required to send the balance in your Checking Account to the state of your last known address. We will make all reasonable efforts to contact you before transferring the remaining balance of your Checking Account to the applicable state. If funds are transferred to the state, you may file a claim with the state to recover the funds.
  12. Statements
    Electronic statements are available to view and print at the Website and Chime Mobile App. Carefully review your statements each statement period and notify us of any errors within sixty (60) days of your statement becoming available. if you do not, you may be responsible for unauthorized transactions as described in the section “Your Liability for Unauthorized Electronic Funds Transfers” below. You will not receive paper statements.
  13. Special Rules for New Accounts
    Checking Accounts open less than thirty calendar days from the date that your first deposit is credited to your Checking Account (“30 days”) or Checking Accounts with a Chime Visa Debit Card that has not been activated (“New Accounts) will be limited in functionality. You may not be eligible to use certain features such as Pay Anyone and Chime Checkbook until the Chime Visa Debit Card has been activated and the Checking Account has been open for at least 30 days. In addition, certain transfer limits may be lower during this time as indicated in Section C, “1. Deposits to the Account”, Section E, “1. Electronic Banking Services” and Section II, “ELECTRONIC FUNDS TRANSFER DISCLOSURE AND SPECIAL TERMS AND CONDITIONS”.

Using the Chime Visa Debit Card

Upon your specific election, you will receive a physical Chime Visa Debit Card (“the Card”) with your Checking Account. You acknowledge and agree that the funds accessible through use of the Card is limited to the available funds in your Checking Account, unless you are eligible for and enrolled in SpotMe. You agree to sign the back of the Card immediately upon receipt. The expiration date of the Card is identified on the front of the Card. The Card is the property of the Issuer and must be surrendered upon demand. The Card is nontransferable, and it may be cancelled, repossessed, or revoked at any time without prior notice subject to applicable law, rule, or regulation.

  1. Activate the Card
    You must activate the Card before it can be used. You may activate it by calling 844-244-6363 or online at chime.com or through the Chime Mobile App. You will need to provide personal information in order for us to verify your identity. Certain functionality outlined in this Agreement may be restricted prior to activating the Card, for details see Section C, “1. Deposits to the Account”, Section E, “1. Electronic Banking Services” and Section II, “ELECTRONIC FUNDS TRANSFER DISCLOSURE AND SPECIAL TERMS AND CONDITIONS.”
  2. Personal Identification Number
    You will not receive a Personal Identification Number (“PIN”) with the Card. However, you will be prompted to select a PIN when you activate it. See the activation instructions in the “Activate The Card” section. You should not write or keep your PIN with your Card. Never share your PIN with anyone. When entering your PIN, be sure it cannot be observed by others and do not enter your PIN into any terminal that appears to be modified or suspicious. If you believe that anyone has gained unauthorized access to your PIN, you should advise us immediately following the procedures in the section labeled “Your Liability for Unauthorized Electronic Funds Transfers.”
  3. Authorized Card or Checking Account Users
    You are responsible for all authorized transactions initiated and fees incurred by use of the Card or Checking Account. If you permit another person to have access to your Card, Card number(s), Checking Account number(s) or PIN, we will treat this as if you have authorized such use and you will be liable for all transactions and fees incurred by those persons. You are wholly responsible for the use of your Checking Account according to the terms and conditions of this Agreement.
  4. Secondary Cardholder
    You may not request an additional Card for another person.
  5. Your Representations and Warranties
    By activating the Card or by retaining, using or authorizing the use of the Card provided with the Checking Account, you represent and warrant to us that:

    • you are at least 18 years of age (or older if you reside in a state where the majority age is older);
    • you are a U.S. citizen or legal alien residing in the fifty (50) states of the United States (“U.S.”) or the District of Columbia
    • you have provided us with a verifiable U.S. Street address (not a P.O. Box)
    • the personal information that you provide to us in connection with the Checking Account is true, correct and complete;
    • you received a copy of this Agreement and agree to be bound by and to comply with its terms; and
    • you accept the Card.
  6. Cash Access and Transaction Limitations
    With your PIN, you may use the Card to obtain cash from your Checking Account at any Automated Teller Machine (“ATM”) or any Point-of-Sale (“POS”) device, as permissible by a merchant, that bears the Visa®, Interlink®, or Plus® Acceptance Marks. All ATM transactions are treated as cash withdrawal transactions. Please note that if you use your Card to get account balance information from an ATM, the balance may not reflect recent transactions, and it will not reflect funds that are in the Secured Deposit Account (even if you are participating in the automatic transfers as set forth in Section C above), and may include funds that are not available for immediate withdrawal. You may use the Card at an ATM and withdraw funds at a participating bank (“Over The Counter” or “OTC” withdrawals). ATM and OTC cash withdrawals, funds withdrawn at a POS, and purchases each count toward the $2,500.00 maximum amount that can be spent on the Card per day. Below are the itemized cash access and spending limits for your Checking Account at the time of account opening. Members may later be eligible for higher transaction limits at our discretion, based on Checking Account history. We may change these limits with notice to you. To determine the current limits that apply to you, you can access them under the settings section of the Chime Mobile App, contact Member Services by calling 844-244-6363 or ask the Chime Chatbot within the Chime Mobile App.

    * Daily limits refer to 24-hour rolling timeframes (for example, Tuesday 2:00pm – Wednesday 2:00pm). ATM and POS device owner-operators, merchants and participating banks may impose their own fees and lower limits on cash withdrawals.

    You may use the Card to purchase or lease goods or services everywhere Visa debit, Interlink or Maestro® Cards are accepted as long as you do not exceed the available balance of your Checking Account. Some merchants do not allow customers to conduct split transactions where the Card is used as partial payment for goods and services and the remainder of the balance is paid with another form of legal tender. If you wish to conduct a split transaction and it is permitted by the merchant, you must tell the merchant to charge only the exact amount of funds available in the Checking Account to the Card. You must then arrange to pay the difference using another payment method. Some merchants may require payment for the remaining balance in cash. If you fail to inform the merchant that you would like to complete a split transaction prior to swiping the Card, the Card is likely to be declined.

    If you use the Card at an automated fuel dispenser (“pay at the pump”), the transaction may be preauthorized for an amount equal to $75.00 or more. If the Card is declined, even though you have sufficient funds available, you should pay for your purchase inside with the cashier. If you use the Card at a restaurant, a hotel, for a car rental purchase, or for similar purchases, the transaction may be preauthorized for the purchase amount plus up to 20% or more to ensure there are sufficient funds available to cover tips or incidental expenses incurred. A preauthorization will place a “hold” on those available funds until the merchant sends us the final payment amount of your purchase. Once the final payment amount is received, the preauthorized amount on hold will be removed. It may take up to seven (7) days for the hold to be removed. During the hold period, you will not have access to the preauthorized amount.

    All transactions relating to car rentals may result in a hold for that amount of funds for up to thirty (30) days.

    If you use the 16-digit Card number without presenting the Card (such as for a mail order, telephone, or Internet purchase), the legal effect will be the same as if you used the Card itself. For security reasons, we may limit the amount or number of transactions you can make with the Card. The Card cannot be redeemed for cash. You may not use the Card for any illegal online gambling or any other illegal transaction.

    Each time you use the Card, you authorize us to reduce the value available in the Checking Account by the amount of the transaction and any applicable fees. Unless you are eligible for and enrolled in SpotMe and acting in accordance with the SpotMe Terms and Conditions, you are not allowed to exceed the available amount in the Checking Account through an individual transaction or a series of transactions. Nevertheless, if a transaction exceeds the balance of the funds available in the Checking Account, you shall remain fully liable to us for the amount of the transaction and any applicable fees, unless such transaction is caused by the authorized use of SpotMe. See these provisions in Section C for additional details if your Checking Account balance becomes negative: “6. No Overdrafts, SpotMe and “7. Right to Set Off.”

    You do not have the right to stop payment on any purchase or payment transaction originated by use of the Card. If you authorize a transaction and then fail to make a purchase of that item as planned, the approval may result in a hold for that amount of funds for up to sixty (60) days.

  7. Non-Visa Debit Transactions
    Merchants are responsible for and must provide you with a clear way of choosing how to make a Visa debit transaction if they support the option. In the past, transactions have been processed as Visa debit transactions unless you entered a PIN. Now, if you do not enter a PIN, transactions may be processed as either a Visa debit, Interlink or as a Maestro transaction. Please be advised that should you choose to use the Interlink or Maestro network when making a transaction without a PIN, different terms may apply. Certain protections and rights applicable only to Visa debit transactions as described in this Agreement will not apply to transactions processed on the Interlink or Maestro network. Please refer to the section labeled “Your Liability for Unauthorized Electronic Funds Transfers” for a description of these rights and protections applicable to Visa debit and non-Visa debit transactions.

    To initiate a Visa debit transaction at a point-of-sale, swipe the Card through the POS terminal, sign the receipt, or provide your 16-digit Card number for a mail order, telephone, or Internet purchase. To initiate a non-Visa debit transaction at the POS, enter your PIN at the POS terminal or provide your 16-digit Card number after clearly indicating a preference to route your transaction as a non-Visa debit transaction for certain bill payment, mail order, telephone, or Internet purchases.

  8. Transactions Made in Foreign Currencies
    If you obtain funds or make a purchase in a currency other than the currency in which the Card was issued, the amount deducted from the available balance of your Checking Account will be converted by Visa into an amount in the currency of the Card. The exchange rate between the transaction currency and the billing currency used for processing international transactions is a rate selected by Visa from the range of rates available in wholesale currency markets for the applicable central processing date, which may vary from the rate Visa itself receives, or the government-mandated rate in effect for the applicable central processing date. The conversion rate may be different from the rate in effect on the date of your transaction and the date it is posted to your account.

    We will not impose a fee for each transaction (U.S. or foreign currency) that you conduct at merchants (including foreign websites) outside the United States or in a foreign currency, however, there may be third-party fees.

  9. Receipts
    You should get a receipt at the time you make a transaction using the Card. You agree to retain, verify, and reconcile your transactions and receipts.
  10. Card Replacement
    If you need to replace the Card for any reason except at Card expiration, you can do so by calling 844-244-6363 or through the Chime Mobile App. You will be required to provide personal information which may include your Checking Account number, 16-digit Card number, full name, transaction history, copies of acceptable documentation, etc.
  11. Card Expiration
    The Card will expire no sooner than the date printed on the front of it. You will not be able to use the Card after the expiration date; however, , a replacement Card will be automatically mailed to you prior to the expiration of the Card. If you need a Card replacement for any reason other than the Card’s expiration, you may request one at any time by following the procedures in the section labeled “Card Replacement.”

Electronic Banking Services

The following features (Chime Checkbook and Pay Anyone) are available with your Checking Account after it has been open for 30 days or more, and your Chime Visa Debit Card has been activated.*

1. Chime Checkbook
With your Checking Account, you will have access to the Chime Checkbook feature (the “Checkbook”) through the Chime Mobile App or Website. The Chime Checkbook does not include a checkbook that enables you to write personal checks from your account, rather, it is a feature which allows you to authorize us to make payments to individuals or companies by check on your behalf. You will not have access to the Checkbook until both your Checking Account has been open for a minimum thirty (30)-day period that begins on the calendar day that your first successful deposit is made to your Checking Account and you have activated your Card.

To initiate a payment using the Checkbook, you must provide the name and mailing address of each individual or company you wish to pay. Once a payment is authorized, the payment amount will be immediately deducted from your Checking Account balance.

You are responsible for verifying the completeness and accuracy of all information you give us for the Checkbook payments. We are not liable for losses resulting from incorrectly entered information on the Checkbook payments.

Payments made using the Checkbook take the form of a paper check sent to the payee on your behalf using standard U.S. Postal Service mail. Please allow three to nine (3-9) business days for delivery of the check. Payments can only be sent to addresses located within the fifty (50) states of the U.S. Checkbook payments are processed daily by 8 AM MST. Checkbook payments initiated after this time will be processed by 8 AM MST the next business day. Chime reserves the right to refuse to process payments to any individual or company. If the decision is made to refuse a payment, Chime will notify you on or before the next business day.

Checkbook payments may be refused or returned by the individual or company to whom the payment was issued. The determination to accept this method of payment is at the discretion of the recipient. The U.S. Postal Service may also return payments in cases of expired or invalid addresses. If the Checkbook payment is returned for any reason, the payment will be voided, and the full amount credited to your Checking Account the next business day. If your Checking Account is closed when the Checkbook payment is returned to us, we will issue you a check and mail it to the address we have on file for you.

Uncashed Checkbook Payments: Uncashed Checkbook payments are voided after 180 days. Funds from voided checks will be credited to your Checking Account by 8 AM MST on the next available business day.


There is no fee to use the Checkbook.

CANCELLING A CHECKBOOK PAYMENT: You may cancel a single Checkbook payment as long as it has not been presented for payment by calling 1-844-244-6363 or by contacting us through the Chime Mobile App. Funds from any cancelled check will be credited to your Checking Account within 1-3 business days.

LIABILITY FOR FAILURE TO STOP PAYMENT OF A CHECKBOOK PAYMENT: If you request cancellation of a Checkbook payment within three (3) three business days or more before it is scheduled to be made, and Chime does not cancel it in time, Chime will be liable for your losses or damages. We assume no liability for any interest or losses that result if your cancellation instructions are not received by us online or through our Chime Mobile App with a reasonable time to act before the check is presented to us.

 

2. Pay Anyone Transfers

Subject to the terms of this Agreement, your Checking Account includes access to the Pay Anyone Transfer Service (“Pay Anyone”, formerly known as “Pay Friends”) via the Chime Mobile App or Website. This service allows you to send money to Chime members or non-Chime members, or receive money from other Chime members or non-Chime members (“Pay Anyone Transfers”). Your receiving of money from non-Chime members is subject to the terms as set forth in the “Requesting and Receiving Funds from Chime members and non-Chime members through Pay Anyone” section below.

Your access to Pay Anyone is determined by Chime in its sole discretion based on the history of any Chime-branded accounts you have, your use of Pay Anyone in the past, direct deposit history and direct deposit amounts and other risk-based factors. Chime may suspend or terminate your use of Pay Anyone at any time and without prior notice to you unless required by applicable law, rule, or regulation. If you violate the terms of Pay Anyone, such actions may be used as a basis to terminate your Checking Account.

By using the Pay Anyone feature, you agree that you will not post, transmit, distribute, or disseminate through any material that: (a) is false, misleading, unlawful, obscene, indecent, lewd, pornographic, defamatory, libelous, threatening, harassing, hateful, abusive, or inflammatory; (b) encourages conduct that would be considered a criminal offense or gives rise to civil liability or violates these terms and the Agreement; or (c); in our sole judgment, is objectionable, restricts or inhibits any person or entity from using or enjoying any portion of Pay Anyone, or which may expose Chime, the Bank, its affiliates or its customers to harm, reputational risk, or liability of any nature.

 

3. Using the Pay Anyone Transfer Service

To send a Pay Anyone Transfer, login to the Chime Mobile App or Website and select ”Pay Anyone.” Next, to select a recipient you may either scroll through your contacts and tap on your selected recipient, or enter the intended recipient’s name, email address, mobile phone number, or the recipient’s Username (referred to as either the “Username” or “$ChimeSign”). Finally, input the Pay Anyone Transfer dollar amount you would like to send and tap “Pay.”

Pay Anyone Transfers are automatically debited from the sender’s Checking Account (which may also include a transfer from, and thus a debit to, your Secured Deposit Account as necessary due to your election to send “From Credit Builder” as set forth in Section C(4)(i) above).

Pay Anyone Transfers will be monitored and may be held, delayed or blocked if, in Chime’s sole discretion, completing the transfer could result in fraud or another form of financial harm. Chime may require additional information to complete a Pay Anyone Transfer.

You must make sure the recipient’s email address; mobile phone number or Username is entered accurately to ensure the Pay Anyone Transfer is sent to the correct recipient. The obligation to pay the Pay Anyone Transfer will be paid as instructed and will not be excused by an error in the information entered.

Username:

By using Pay Anyone, you are representing that you are the owner of the mobile phone number or email address associated with your Checking Account. You consent to have the first and last name registered on your Checking Account associated with the Username; which will be visible to other Chime members who search for you by Username. This will assist the sending Chime member in verifying that you are the correct intended recipient of the Pay Anyone Transfer. You may change your Username at any time by going to your Settings and tapping Edit in the Personal Information Section.

Please note: The email address, mobile phone number or Username entered during the Pay Anyone Transfer will display in your transaction history and on your statement for your reference. Additionally, if a Username was used to facilitate the Pay Anyone Transfer, the first name and last initial of the receiving Chime member will display in your transaction history after the Pay Anyone Transfer has been processed. A reference field is also available to add a personalized message to the recipient. These messages will be visible in your online transaction history but will not be included on your monthly statement.

 

4. Requesting and Receiving Funds from Chime members and non-Chime members through Pay Anyone

 

(a.) Chime members

You may request funds to be transferred to you from a Chime member through Pay Anyone by designating the amount of funds requested and your selected Chime member sender. If the Chime member sender approves your request for funds, your request will become the Chime member sender’s Pay Anyone Transfer and be processed in accordance with the Pay Anyone Transfers terms.

*Please note: During a calendar month, a Chime member cannot request more than the per calendar month receive limit as stated below in the Pay Anyone Transfer Limits section below.

 

(b.) Non-Chime members

Not all new or existing Chime members are eligible to request or receive money from non-Chime members. We determine your eligibility in our sole discretion based on qualification and enrollment requirements including the history of any Chime branded accounts that you have, direct deposit history, direct deposit amounts and any other risk based factors. We reserve the right to change any requirements in our sole discretion at any time and without prior notice.

However, if you are an eligible Chime member, you may request funds to be transferred to you from a non-Chime member through Pay Anyone by designating the amount of funds requested and your selected non-Chime member sender. If the non-Chime member sender approves your request for funds, your request will become the non-Chime member sender’s Pay Anyone Transfer and be processed in accordance with the Pay Anyone Transfers terms.

*Please note the following for the requesting and receiving of funds from a non-Chime member:

  • (i) A non-Chime member may only use the following type of debit card: (i) non-Chime issued, (ii) U.S. bank issued, and (iii) non pre-paid;
  • (ii) During a calendar month, a Chime member can only request (per one or multiple requests) a total of $1,000.00 from a non-Chime member. For the avoidance of doubt, the $1,000.00, or lesser requested total amount for that calendar month, counts towards the per calendar month receive limit as stated below in the Pay Anyone Transfer Limits section below;
  • (iii) Due to risk based factors, a Chime member may be limited in the frequency of requests per day and also in the frequency of requests for a request amount of less than a certain dollar amount (ie $1.00).

 

5. Recipients of Pay Anyone Transfers

You may initiate sending money to a Chime member or non-Chime member. Once you have selected and confirmed your recipient’s email address or phone number, input the Pay Anyone Transfer dollar amount you would like to send and tap “Pay.”

Pay Anyone Transfers between Chime Members

      • The sender and recipient must have an active Chime Checking Account in order to receive a Pay Anyone Transfer(s).
      • Pay Anyone Transfers will be applied to the Checking Account associated with the recipient’s email address, mobile phone number, or Username entered by the sender.
      • Approved Pay Anyone Transfers between Chime members are automatically debited from the sender’s Checking Account (which may also include a transfer from, and thus a debit to, your Secured Deposit Account as necessary due to your election to send “From Credit Builder” as set forth in Section C(4)(i) above).

Prior to sending a Pay Anyone Transfer, the sender will be prompted to confirm the transaction. Once the Pay Anyone Transfer is sent, it cannot be canceled. It is the sender’s responsibility to ensure the information is accurate prior to confirming the Pay Anyone Transfer request.

A Pay Anyone Transfer cannot be cancelled if sent to another Chime member once the transfer is complete.

 

6. Pay Anyone Transfers to Non-Chime Members

If your recipient is not a Chime member, then they will receive a Short Message Service (“SMS”) notification or email, depending on what information you provided, indicating that you have sent them money. In order for the transaction to be completed, your Recipient must claim the money within fourteen (14) days.

The non-Chime member recipient may claim funds in one of two ways:

      • The recipient may apply and be approved for a Chime Checking Account. The funds will be deposited into the recipient’s Chime Checking Account
      • The recipient may claim the funds by using the landing page in the notification received in the above steps, and inputting all information required on Chime’s webpage.

If the recipient does not claim the money within fourteen (14) days, the payment will be cancelled, and the Pay Anyone Transfer dollar amount will be returned to your Checking Account. You can cancel a Pay Anyone Transfer to a non-Chime member in the Chime Mobile App within fourteen (14) days of initiating the transfer, as long as the non-Chime member has not already claimed the funds.

Fees: There are no fees associated with the use of the Pay Anyone Transfer Service.

Mobile Carrier Information: By registering a mobile phone number on your Checking Account, you are certifying that you are the owner of the mobile phone account or have the account owner’s permission to register the mobile phone number.

Message and data rates may apply to the use of the mobile device when using the Pay Anyone Transfer service via the Chime Mobile App.

 

7. Pay Anyone Transfer Limits

Pay Anyone Transfers may be initiated at any time as long as the transfer request does not exceed the available balance in your Checking Account (or in your Secured Deposit Account as applicable due to your election to send “From Credit Builder” as set forth in Section C(4)(i) above).

Chime may refuse to process any transaction that exceeds any of the limits described below. If your Pay Anyone Transfer is denied because your Checking Account balance, or your Secured Deposit Account balance (as applicable due to your election to send “From Credit Builder” as set forth in Section C(4)(i) above), is not sufficient, you are responsible for making alternate payment arrangements with the intended recipient. For incoming transfers, if you have a negative Checking Account balance, the incoming transfer will be applied first to cover that negative balance, so there may be instances where you need to transfer in more funds than the amount of the desired Pay Anyone Transfer, in order to cover both the negative balance and the Pay Anyone Transfer. These are the limits associated with Pay Anyone Transfer(s):

** Additional frequency and/or dollar limits for the requesting and receiving of funds from a non-Chime member are set forth in the “Requesting and Receiving Funds from Chime members and non-Chime members through Pay Anyone” section above.

If your Checking Account balance, or the balance from your Secured Deposit Account if you are participating in the automatic transfers as set forth in Section I(C) above, is not sufficient to make a Pay Anyone transfer, you may have the option, at Chime’s discretion, to link a valid external debit card from an outside financial institution to your Checking Account to make a Pay Anyone Transfer up to the following limits: Send of up to $1,000 per calendar month.

Non-Chime members may also be subject to their own frequency and/or dollar limits with regard to Pay Anyone Transfers.

Members may be eligible for higher transfer limits based on Checking Account history at our discretion.

We may change these limits with notice to you. To determine the current limits that apply to you, you can access them under the settings section of the Chime Mobile App, contact Member Services by calling 844- 244-6363 or ask the Chime Chatbot within the Chime Mobile App

 

8. Liability for Pay Anyone Transfers

You are liable for any Pay Anyone Transfer sent from your Checking Account except in the case where the Pay Anyone Transfer was unauthorized, or the Pay Anyone Transfer was not properly executed by Chime, according to your instructions. This means you are liable for any transaction made using Pay Anyone, even if you are unsatisfied with an exchange of goods or services.

If you receive a Pay Anyone Transfer and we later determine in our sole discretion that the Pay Anyone Transfer was invalid for any reason, (for example, the Pay Anyone Transfer was not authorized by the sender) you hereby authorize us to debit your Checking Account for the amount of the invalid Pay Anyone Transfer. In the event that a negative balance is created in your Checking Account as a result of debiting your Checking Account for the invalid Pay Anyone Transfer, you hereby authorize us to move funds from any optional Chime Account you own in an amount equal to or less than the Pay Anyone Transfer.

If you believe your Checking Account has been compromised or that a Pay Anyone Transfer from your Checking Account was completed without your permission, please contact 1-844-244-6363 immediately. Please see Section II ELECTRONIC FUNDS TRANSFER DISCLOSURE AND SPECIAL TERMS AND CONDITIONS below, where your liability for unauthorized transfers from the Checking Account is explained.

Electronic Funds Transfer Disclosure And Special Terms And Conditions

A. Your Checking Account number and bank routing number can be used for the following:

  1. preauthorized direct debits (“ACH Debit(s)”) from merchants, Internet service or other utility service providers (“Merchants).
  2. for the purpose of initiating ACH transactions to or from your Checking Account (including Recurring Transfers and direct deposits).
  3. for the purpose of making automatic transfers between your Secured Deposit Account and Checking Account as set forth in Section I(C) above.
  4. for the purpose of making automatic transfers of funds from your Checking Account or Secured Deposit Account to your SpotMe Overdraft Line of Credit Account as set forth in Section I(C) 5 above.

Note: The recipient’s name on any direct deposits or ACH credits we receive must match the name on the Checking Account. Any direct deposits received in a name other than the name registered to the Checking Account will be returned to the originator.


Limits on ACH Debit Transactions

Cut-off Time – The cut-off time for scheduling ACH transfers is 12 pm Pacific Standard Time on a business day. Any transfer scheduled after the cut-off time will be treated as if it were scheduled on the next business day.

ACH Debit Limits – The limitations to the amount of funds that can be transferred from your Checking Account per day are as follows:

Electronic Funds Transfer Services

The following terms are used to describe Electronic Funds Transfer (“EFT”) services. “Automated credits” or “direct deposits” are deposits made to your Checking Account by electronic means. “Automated debits” and “automated payments” indicate payments authorized by you to be made from your Checking Account by electronic means. “Online Transfers” are the movement of funds between your Checking Account and optional Chime Savings Account by use of the Chime Mobile App or the Website. Online Transfers are described in detail in the agreement governing the Chime Savings Account. Automatic Transfers include inter-bank transfers between accounts at Chime bank partners (for example, a transfer from a Bancorp Checking Account to the Stride Secured Deposit Account) and include automatic transfers described in Section C above, as applicable to your particular account holding institutions.

When you accept direct deposits or authorize automatic payments/debits or transfers to or from your Checking Account, you agree to these terms and conditions.

Other relevant terms and conditions described elsewhere in the Agreement also apply as long as they are consistent with Regulation E or Section II.

  1. Types of Electronic Funds Transfers Available

    • You may arrange with another party, such as your employer or a government agency, to electronically deposit funds on a one-time or recurring basis directly to your Checking Account.
    • You may authorize another party, such as a merchant, to make a one-time or recurring payment(s) using the Checking Account and bank routing numbers, directly from your Checking Account subject to the established limitations on withdrawals and transfers.
    • You may use the Card to make purchases at merchants that accept the Card or to obtain cash at ATMs, over the terminals.
    • You may initiate ACH transactions to or from your Checking Account.
    • You may make automatic transfers of funds from or to your Secured Deposit Account or Checking Account as set forth I C above.
  2. Limitations on Transfers, Amounts and Frequency of Transactions

    • You may make cash withdrawals and POS purchases, not to exceed the established limits for your Checking Account. See the section labeled “Cash Access and Transaction Limitations” for details about the limits.
    • If your Checking Account is closed, blocked or suspended for any reason, you will not be able to transact using your Card (including at an ATM).
    • See Section I(C) for any information on amounts and frequencies for automatic transfers.
  3. Right to Receive Documentation of Electronic Funds Transfers

    • Statements. Each month, you will have access to an electronic monthly statement that can be viewed on the Website and Chime Mobile App. You will also have access to transaction authorizations and settlements within of the transaction on the Chime Mobile App and by logging on to your account at chime.com. You should carefully review your statements each statement period and let us know as soon as possible if there are any errors. If you do not, you may be responsible for unauthorized transactions as described in Section 7 “Your Liability for Unauthorized Electronic Funds Transfers” below. We do not mail monthly paper statements.
    • Direct Deposits or Automated Credits. If you have arranged to have direct deposits made to your Checking Account at least once every sixty (60) days from the same person or company, check your transaction history through the Chime Mobile App to find out if the deposit has been made.
  4. Right to Stop Payment of Preauthorized Transfers and Procedures for Doing So
    If you scheduled a one-time ACH transfer over the phone or recurring ACH transfers using a written authorization form, you can stop any of these payments. Here’s how: To stop a recurring ACH transfer to a merchant you preauthorized to debit your Checking Account, please contact the merchant to request cancellation of the recurring payment. If the merchant with whom you arranged recurring ACH transfers from your Checking Account is unable or unwilling to stop the transfer to request a stop on such payment. If you call, we may require you to put your request in writing and to provide us with a copy of your notice to the payee, revoking the payee’s authority to originate debits to your account, within 14 days after you call. If we do not receive the written confirmation within 14 days, we may honor subsequent debits to your account. Your request to stop payment must be received at least three (3) business days before the payment is scheduled to be made. If you fail to give us your request at least three business days prior to a transfer, we may attempt, at our sole discretion, to stop the payment. We assume no responsibility for our failure or refusal to do so, however, even if we accept the request for processing. Such a stop payment request will cancel a single, i.e. one (1) recurring payment. If you want to permanently stop all recurring payments to a specific merchant you will be required to put your request in writing within fourteen (14) days after your notification to stop such payments. You will need to tell us; the name of the payee, the dollar amount of the payment and the date of the payment. If written stop payment notification is not received within fourteen (14) days, the payment in question will be honored as originally authorized and future payments will not be permanently stopped. If you order us to stop one of these payments at least three business days before the transfer is scheduled and we do not do so, we will be liable for your losses or damages.
  5. Notice of Varying Amounts
    If the recurring ACH transfers you make might vary in amount, the person you are going to pay will tell you the transfer date and the amount of the transfer ten (10) days before each payment is scheduled to take place. (You may choose instead to get this notice only when the payment would differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits you set).
  6. Liability for Failure to Stop Payment of Preauthorized Transfer
    If you order us to stop a preauthorized payment three (3) business days or more before the transfer is scheduled, and we do not do so, we will be liable for your losses or damages subject to any limits of liability.
  7. Your Liability for Unauthorized Electronic Funds Transfers
    Tell us at once if you believe your Card, PIN or Checking Account number has been lost or stolen. Reaching out to us immediately by phone is the best way to minimize your losses. Call 1-844-244-6363 if your Card, PIN or Checking Account number has been lost or stolen, or if someone has transferred or may transfer money from your Checking Account without your permission. You could lose all the money in your account. If you tell us within two business days after you learn of the loss or theft of your Card, PIN, or Checking Account, you can lose no more than $50 if someone used your Card, PIN or Checking Account without your permission. Under Visa U.S.A. Inc. Operating Regulations, your liability for unauthorized Visa debit transactions on your Checking Account is $0.00 unless we determine that you were grossly negligent or fraudulent in the handling of your Card. This reduced liability does not apply to certain commercial card transactions, transactions not processed by Visa or to ATM transactions outside the U.S. In the event that the Visa Zero Liability Rules do not apply, if you do not notify us within two (2) business days after you learn of the loss or theft of your Card, PIN, or Checking Account number and we can prove that we could have stopped someone from using your Checking Account without your permission if you had promptly notified us, you may be liable for as much as $500.00.


    Also, if your statement shows transactions that you did not make, including those made by Card, PIN, or other means, notify us at once following the procedures stated in the section labeled “In Case of Errors or Questions About Your Electronic Transfers” below. If you do not notify us within sixty (60) days after you become aware of the transaction(s) and/or the statement was made available to you, you may not get back any of the value you lost after the sixty (60) days, if we can prove that we could have stopped someone from taking value if you had notified us in time. If a good reason (such as a long trip or a hospital stay) kept you from telling us, we will extend the time periods. If your Card, PIN or Checking Account number has been lost or stolen, we will close your Card and/or Chime Account to keep losses down and send you a replacement Card and/or Checking Account number.

    If your Checking Account changes you must immediately notify your employer or any other payors or merchants. You must provide them with your new Chime Account number to ensure that your direct deposit and/or ACH Debit activity continues uninterrupted.

  8.  Our Liability for Failure to Complete Transactions
    If we do not complete a transaction from your Checking Account or Card on time or in the correct amount according to our Agreement with you; we will be liable for your losses or damages. However, there are some exceptions. We will not be liable, for instance, if:

    • Through no fault of ours, you do not have enough available funds in your Checking Account (if you are participating in the automatic transfers as set forth in Section C above), to complete the transaction;
    • A merchant refuses to accept your Card or Checking Account number;
    • The information supplied by you or a third party is incorrect, incomplete, ambiguous or untimely;
    • An ATM where you are making a cash withdrawal does not have enough cash;
    • An electronic terminal (Point of Sale or ATM) where you are making a transaction does not operate properly, and you knew about the problem when you initiated the transaction;
    • Access to your Card or Checking Account has been blocked after you reported your Card or Checking Account number lost or stolen;
    • The transaction cannot be completed because your Card is damaged;
    • There is a hold or your funds are subject to legal or administrative process or other encumbrance restricting their use;
    • We have reason to believe the requested transaction is unauthorized;
    • Circumstances beyond our control (such as fire, flood, power failure, strike, labor dispute, critical service provider failure, computer breakdown, telephone line disruption, government or regulatory action, or a natural disaster) prevent or delay the completion of the transaction, despite reasonable precautions that we have taken; or
    • Any other exception stated in our Agreement with you.
  9. Confidentiality
    We may disclose information to third parties about your Checking Account, Card or the transactions you make:

    • Where it is necessary or helpful for completing transactions;
    • In order to verify the existence and condition of your Checking Account or Card for a third party, such as a merchant;
    • In order to comply with government agency, court order, or other legal or administrative reporting requirements;
    • If you give us your consent;
    • To our employees, auditors, affiliates, service providers, or attorneys as needed;
    • In order to identify, prevent, investigate or report possible suspicious or illegal activity;
    • To disclose the existence, history, and condition of your account to consumer reporting agencies;
    • As noted in the Chime Privacy Policy and Bank Consumer Privacy Notice(s); or
    • Otherwise as permitted by law or necessary to fulfill our obligations under this agreement.

  10. In Case of Errors or Questions About Your Electronic Transfers
    In case of errors or questions about your electronic transactions, call 1-844-244-6363, contact us through the Chime Mobile App, or write to Chime Member Services, P.O. Box 417, San Francisco, CA 94104-0417 as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. We must hear from you no later than sixty (60) days after the earlier of the date you electronically accessed your Checking Account, if the error could be viewed in your electronic history, or the date we sent the FIRST written history on which the error appeared. You may request a written history of your transactions at any time by calling 1-844-244-6363 or contacting us through the Chime Mobile App. You will need to tell us:

    • Your name, Checking Account number and/or 16-digit Card number
    • Why you believe there is an error, and the dollar amount involved
    • Approximately when the error took place

    In addition, you may provide us with any supporting documentation related to the error.

    If you provide this information orally, we may require that you send your complaint or question in writing within ten (10) business days.

     

    We will determine whether an error occurred within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to forty-five (45) days to investigate your complaint or question. If we decide to do this, we will provisionally credit your Checking Account within ten (10) business days for the amount you think is in error, so that you will have use of the money during the time it takes us to complete the investigation. If we ask you to put your complaint or question in writing and you do not provide it within ten (10) business days, we may not provisionally credit your Checking Account.

     

    For errors involving new Checking Accounts; transactions with a merchant’s POS terminal, whether in-person, online, by telephone, mail, or otherwise; or foreign-initiated transactions, we may take up to ninety (90) days to investigate your complaint or question. For new Checking Accounts, we may take up to twenty (20) business days to credit your Checking Account for the amount you think is in error. For errors involving unauthorized preauthorized debits (“ACH”), we will ask you to complete and sign an “Affidavit of Unauthorized ACH” and return it to us to assist in our investigation.

    We will tell you the results within three (3) business days after completing the investigation. If we decide that there was no error, we will send you a written explanation. Copies of the documentation used in the investigation may be obtained by contacting us at the phone number or address shown at the beginning of this section.   11. English Language Controls
    Any translation of this Agreement is provided for your convenience. The meaning of the terms, conditions and representations herein are subject to definitions and interpretations in the English language. Any translation provided may not accurately represent the information in the original English.

    From time to time we may monitor and/or record telephone calls between you and us to assure the quality of our member service team or as required by applicable law.
  14. No Warranty Regarding Goods or Services as Applicable
    We are not responsible for the quality, safety, legality, or any other aspect of any goods or services you purchase using your Checking Account.
  15. Arbitration

    ARBITRATION NOTICE: THIS AGREEMENT CONTAINS AN ARBITRATION CLAUSE. PLEASE READ THIS PROVISION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS.

    ALL CLAIMS ARISING OUT OF THIS AGREEMENT ARE SUBJECT TO MANDATORY AND BINDING ARBITRATION. YOU HEREBY KNOWINGLY AND VOLUNTARILY WAIVE THE RIGHT TO LITIGATE ANY CLAIM THROUGH A COURT. IN ARBITRATION, NEITHER PARTY WILL HAVE THE RIGHT TO A JURY TRIAL OR TO ENGAGE IN DISCOVERY, EXCEPT AS PROVIDED FOR IN THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) CODE OF PROCEDURE. YOU FURTHER ACKNOWLEDGE THAT YOU HAVE READ THIS ARBITRATION PROVISION CAREFULLY, AGREE TO ITS TERMS, AND ARE ENTERING INTO THIS AGREEMENT VOLUNTARILY AND NOT IN RELIANCE ON ANY PROMISES OR REPRESENTATIONS WHATSOEVER EXCEPT THOSE CONTAINED IN THIS AGREEMENT.

    Except as expressly provided herein, any claim, dispute or controversy (whether based upon contract; tort, intentional or otherwise; constitution; statute; common law; or equity and whether pre-existing, present or future), including initial claims, counter-claims, cross-claims and third- party claims, arising from or relating to: i) this Agreement; ii) the Checking Account; iii) your acquisition of the Checking Account; iv) your use of the Checking Account; v) the amount of available funds in the Checking Account; vi) advertisements, promotions or oral or written statements related to the Checking Account, as well as goods or services purchased with the Checking Account; vii) the benefits and services related to the Checking Account; or viii) transactions made using the Checking Account, no matter how described, pleaded or styled (“Claim”), shall be FINALLY and EXCLUSIVELY resolved, upon the election of you or us (our agents, employees, successors, representatives, affiliated companies, or assigns), by binding arbitration conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. This arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (9 U.S.C. 1-16) (the “FAA”).

    You may obtain copies of the current rules, forms, and instructions for initiating an arbitration with the AAA by contacting the AAA as follows: on the web at www.adr.org or by writing to AAA at 1633 Broadway, 10th Floor, New York, NY 10019.

    Other Claims Subject to Arbitration. In addition to Claims brought by either you or us, Claims made by or against us or by or against anyone connected with you or us or claiming through you or us (including a second cardholder, employee, agent, representative, affiliated company, predecessor or successor, heir, assignee, or trustee in bankruptcy) shall be subject to arbitration as described herein.

    Arbitration Fees. If you initiate arbitration, we will advance any arbitration fees, including any required deposit. If we initiate or elect arbitration, we will pay the entire amount of the arbitration fees, including any required deposit. We will also be responsible for payment and/or reimbursement of any arbitration fees to the extent that such fees exceed the amount of the filing fees you would have incurred if your Claim had been brought in the state or federal court nearest your residence with jurisdiction over the Claims.

    Other Claims Subject to Arbitration. In addition to Claims brought by either you or us, Claims made by or against us or by or against anyone connected with you or us or claiming through you or us (including a second cardholder, employee, agent, representative, affiliated company, predecessor or successor, heir, assignee, or trustee in bankruptcy) shall be subject to arbitration as described herein.

    Procedure. A single arbitrator will resolve the Claims. The arbitrator will be a lawyer with at least ten years’ experience or who is a former or retired judge. The arbitration shall follow the rules and procedures of the arbitration administrator in effect on the date the arbitration is filed, except when there is a conflict or inconsistency between the rules and procedures of the arbitration administrator and this arbitration provision, in which case this arbitration provision shall govern. Any in-person arbitration hearing for a Claim shall take place within the federal judicial district in which you live or at such other reasonably convenient location as agreed by the parties. The arbitrator shall apply applicable substantive law consistent with the Federal Arbitration Act, 9 U.S.C. § 1 et seq. (the “FAA”) and shall honor all claims of privilege and confidentiality recognized at law. The arbitrator shall apply applicable substantive law consistent with, 9 U.S.C. § 1 et seq. and shall honor all claims of privilege and confidentiality recognized at law. All statutes of limitations that would otherwise be applicable shall apply to any arbitration proceeding. The arbitrator shall be empowered to grant whatever relief would be available in court under law or in equity. Any appropriate court may enter judgment upon the arbitrator’s award. 


    All determinations as to the scope, interpretation, enforceability and validity of this Agreement shall be made final exclusively by the arbitrator, which award shall be binding and final. Judgment on the arbitration award may be entered in any court having jurisdiction.

    NO CLASS ACTION, OR OTHER REPRESENTATIVE ACTION OR PRIVATE ATTORNEY GENERAL ACTION OR JOINDER OR CONSOLIDATION OF ANY CLAIM WITH A CLAIM OF ANOTHER PERSON OR CLASS OF CLAIMANTS SHALL BE ALLOWABLE.

    IF YOU DO NOT AGREE TO THE TERMS OF THIS ARBITRATION AGREEMENT, DO NOT ACTIVATE OR USE THE CARD OR CHECKING ACCOUNT. CALL 1-844-244-6363 TO CLOSE THE CHECKING ACCOUNT AND REQUEST A REFUND, IF APPLICABLE.

    Survival. This arbitration provision shall survive: i) the termination of the Agreement; ii) the bankruptcy of any party; iii) any transfer, sale or assignment of your Checking Account, or any amounts owed on your Checking Account, to any other person or entity; or iv) closing of the Checking Account. If any portion of this arbitration provision is deemed invalid or unenforceable, the remaining portions shall remain in force.

Truth in Savings Disclosures

The Checking Account is not an interest-bearing account. No interest will be paid.

  • Minimum Balance Requirements: There is no initial deposit required to open a Checking Account. You may deposit any amount you wish when opening the Checking Account, however, the Checking Account will remain in a new account status until thirty (30) days after the Checking Account has received a posted deposit. See section IV.13. labeled “Mobile Deposit Funds Availability” for additional details.
  • Transaction Limitations: Minimum and maximum withdrawal limitations apply. See the section labeled “Cash Access and Transaction Limitations” for full information regarding these limits.
  • Referral Bonus: You will receive a referral bonus of $75.00 if you enroll for your Checking Account using: 1) a valid referral link from an existing Chime member, and 2) receive a payroll direct deposit of $200 from your employer, payroll provider, or benefits payer by Automated Clearing House (ACH) deposit within forty-five (45) days of opening your Checking Account. Bank ACH transfer, Pay Anyone transfers, verification or trial deposits from financial institutions, transfers from PayPal or Venmo, mobile check deposits, and cash deposits do not qualify as a payroll direct deposit.
  • The bonus will be paid within two (2) business days after the qualifying funds are deposited into your Checking Account.

Mobile Check Deposit

  1. Description of Service Generally
    Once you have received and activated your Card with your name on it, and if we, in our sole discretion, make mobile check deposit (“Mobile Deposit” or “Mobile Check Deposit”) available to you, you can use Mobile Deposit to capture images of Eligible Checks (as defined below) in compliance with our requirements and applicable law, and then transmit those images and other data to us electronically for deposit to your Checking Account. The check image and associated information transmitted electronically are called collectively the “Check Image.” We may process and collect the Check Images you send us in any manner we choose in our sole discretion. The paper instrument to which the Check Image relates is called the “Original Check.”Checks deposited using Mobile Deposit must be endorsed in the same way it is made payable to you. Chime may in its discretion accept checks jointly payable to you and one or more other person(s) if at least one payee matches the name on the Checking Account and (e.g., tax refunds for jointly filed returns), but only if endorsed by all payees. All checks deposited using Mobile Deposit must include a restrictive endorsement stating “For Mobile Deposit Only to Chime Checking Account # XXXXXXX” or as otherwise instructed by Chime. If the Check Image is accepted for deposit, Chime will notify you electronically through the communication method(s) you have elected as preference (“Electronic Notice”). The Bank will then attempt to collect the item by presenting the image or converting the image into a digital representation of the original check (“Substitute Check”). Unlike traditional check deposits, you retain the Original Check when you use Mobile Deposit. See the section “Retention of Original Check” for retention requirements. The way Substitute Checks are cleared, presented for payment and deposited will be determined by the Bank, in our sole discretion. You may not use Mobile Deposit to make deposits to your Savings Account.
  2. Using Mobile Deposit
    You agree to: (a) implement any changes or upgrades to Mobile Deposit that we may require; (b) follow our Mobile Deposit instructions for capturing and transmitting Check Images to us; (c) view each Check Image as it is scanned to ensure that the images (front and back) are being captured properly; and (d) if requested, provide us with the Original Checks that are not destroyed and still within your possession (or sufficient copies of the Original Checks) within five business days of our request. A “sufficient copy” of an Original Check is a paper reproduction of an Original Check that accurately represents all of the information on the front and back of the Original Check as of the time the image was transmitted to us by means of Mobile Deposit. You agree not to transfer, deposit, negotiate, or otherwise use any Original Check (or a copy of any Original Check) once we confirm its receipt by us through Mobile Deposit. Once you transmit an Original Check to us, you agree to safeguard the Original Check from access by others. You may use Mobile Deposit only for non-business, personal use in accordance with this Agreement. By transmitting a Check Image to us through the Chime Mobile App, you authorize us to contact you, including via email and the mobile telephone number you have most recently provided us in respect of your Checking Account, regarding any processing issue or collection effort with respect to such Check Image. If warranted, in our reasonable judgment, we reserve the right to monitor your use of Mobile Deposit, and you agree to cooperate with us to permit such monitoring, to confirm that you have satisfied your obligations under these Terms and Conditions. Chime, acting as an agent of the Bank, may change, modify, add or remove functionality from Mobile Deposit at any time, with or without notice to you.

  3. Mobile Deposit Eligibility
    Not all new or existing customers are eligible to use Mobile Deposit. We determine your eligibility for Mobile Deposit in our sole discretion based on qualification and enrollment requirements including the history of any Chime-branded accounts you have, direct deposit history, and direct deposit amounts and other risk-based factors. Chime may suspend or terminate your use of Mobile Deposit at any time and without prior notice to you. We reserve the right to change the qualification and enrollment requirements in our sole discretion at any time without prior notice. We may require you to upload a picture of your driver’s license or other identifying documents prior to using Mobile Deposit. Eligibility requirements can be found online after you have signed into your Checking Account.
  4. Mobile Deposit Technical Requirements
    To use Mobile Deposit, you must have an Apple iOS or Android smartphone capable of installing and running the Chime Mobile App (see relevant app store details for specific hardware and OS requirements) that is additionally equipped with a camera capable of taking photos with at least a resolution of 1600 x 1200 pixels (“2 Megapixels”). You are responsible for providing and maintaining the equipment that is necessary for use of Mobile Deposit. We assume no responsibility for any errors, failures, or malfunctions of your mobile device, or for any virus or related problems that may occur in connection with your use of Mobile Deposit.
  5. Mobile Deposit Availability and Maintenance
    Subject to the terms of the Mobile Deposit Funds Availability, Mobile Deposit can be utilized 24 hours a day, seven days a week, except when the system is unavailable due to needed maintenance or system outages. We are not responsible for the unavailability of Mobile Deposit or any damages that may result from its unavailability. NOTICE: YOU AGREE THAT YOUR USE OF MOBILE DEPOSIT AND ALL INFORMATION AND CONTENT (INCLUDING THAT OF THIRD PARTIES) IS AT YOUR RISK AND IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. Attempts to provide prior notice of scheduled maintenance will be made, but we cannot guarantee that such notice will be provided.
  6. Security Procedures
    You are required to use the online login credentials established for your Card (collectively, “Password”) to access Mobile Deposit. You agree to: (a) review and comply with the online instructions we provide for using Mobile Deposit; (b) take reasonable steps to safeguard the confidentiality and security of your Password; (c) refrain from disclosing your Password to others; (d) notify us immediately if you have any reason to believe the security or confidentiality required by this provision has been or may be breached; and include immediately change your Password if you know or suspect that the confidentiality of the Password has been compromised in any way. Our security procedure is designed to verify your identity. It is not designed to detect errors by you. We may elect, at our discretion, to verify the authenticity or content of any transmission by placing a call to any owner or authorized user of your Card. We may deny access to Mobile Deposit without prior notice if we are unable to confirm to our satisfaction any person’s authority to access Mobile Deposit or if we believe such action is necessary for security reasons. You agree to be responsible for any transmission or transaction we receive through Mobile Deposit, even if it is not authorized by you, provided it includes your Password or is otherwise processed by us in accordance with our security procedure. Each time you transmit a Check Image to us, you agree that our security procedures are commercially reasonable (based on the normal size, type, and frequency of your transactions).
  7. Fees
    There is no fee for depositing a check via Mobile Deposit. If a check you deposit using Mobile Deposit is returned by the bank upon which it was drawn (for any reason), there is also no fee.Please note that your mobile carrier may charge you for sending and receiving data to upload Check Images using the Chime Mobile App. Please check your mobile service agreement for details on applicable fees.
  8. Limits and Funds Availability
    Limits may be imposed on the dollar amount or number of deposits you make through Mobile Deposit. If you attempt to make a deposit in excess of these limits, we may, at our sole discretion, reject your deposit. If we permit you to make a deposit in excess of these limits, such deposit will still be subject to the terms of this Agreement, and we will not be obligated to allow such a deposit at other times. We may change such limits at any time at our discretion. Your Mobile Deposit funds are generally made available as described below. However, Chime may in its sole discretion apply greater or lesser hold times based on the institution on which a check is drawn, the history of any Chime-branded accounts you have, direct deposit history and direct deposit amounts, spending activity and other risk-based factors.

    For items with “Next-Day Availability” (see below) deposited in a single day, the first $5,525.00 may be available the next business day after the deposits are processed.

    When you make a Mobile Check Deposit, we will tell you when the funds will be available. Unless your Mobile Deposit is rejected or subject to a “Longer Delay” (see below), funds will be available no later than five (5) business days after the deposit is processed.

    We may change these limits with notice to you. To determine the current limits that apply to you, you can access them under the settings section of the Chime Mobile App, contact Member Services by calling 844- 244-6363 or ask the Chime Chatbot within the Chime Mobile App.

    NOTE: If you are participating in the automatic transfers as set forth in Section I(C) above, you acknowledge and agree that Eligible Deposits (as defined in Section I(C) above) which also include mobile deposits, will be transferred to and made available according to the terms governing the Secured Deposit Account.

    Business Days and Cutoff Time
    Our Business Days are Monday through Friday excluding federal holidays.Check Images received and accepted for processing prior to 5:00 PM ET on a business day that we are open are considered received as of that day. Otherwise, the Check Images will be considered received on the next business day.

    Next-Day Availability
    The first $5,525.00 of the following checks may be available the next business day after the deposit is processed:

      • U.S. Treasury Checks

    The amount above $5,525 may be available at the same time. However, it may be subject to longer delays at Chime’s sole discretion. If we delay the availability of funds in excess of $5,525 for these deposits for any reason, we will notify you at the time of your deposit and we will tell you when the funds will be available. Unless your Mobile Deposit is rejected or subject to a “Longer Delay” (see below), The funds will be available no later than five (5) business days after the deposit is processed.

     

    All Other Checks
    Chime, at its sole discretion, may make some or all of the funds available the next business day after the deposit is processed for:

    Other verified checks drawn on a bank in the United States, including:

    • Personal and Business Checks
    • State and Local Government Checks
    • Federal Reserve Bank Checks
    • Federal Home Loan Bank Checks
    • Certified Checks

    If we delay the availability of funds for these deposits for any reason, we will notify you at the time of your deposit, and we will tell you when the funds will be available. If the actual amount of the check does not match the amount that you enter when making your Mobile Check Deposit, your funds availability may be longer than what we tell you. Unless your Mobile Deposit is rejected or subject to a “Longer Delay” (see below), the funds will be available no later than five (5) business days after the deposit is processed.

     

    Longer Delays May Apply
    As indicated above, under certain circumstances, a longer hold period may apply before funds deposited by check are available. These circumstances are inclusive of but not exhaustive:

    • Chime or the Bank believes a deposited check will not be paid.
    • You deposit checks totaling more than $5,525.00 in one (1) day.
    • You redeposit a check that has been previously returned unpaid.
    • Your Checking Account has had a negative balance anytime in the last six (6) months.
    • Chime or the Bank experiences an emergency, such as fire, flood, failure of communication, computer or other equipment, a suspension of payments by another bank, government or regulatory action, or other exigent condition beyond Chime’s or Bank’s control.

    Chime will send an Electronic Notice informing you if your ability to withdraw funds is delayed for any reason, and we will tell you when the funds will be available.

  9. Prohibited Checks
    You may only use Mobile Deposit to scan and transmit Eligible Checks made payable solely to you and which are properly endorsed by you. You agree that we are not obligated to accept for deposit any Check Image we receive and that we, in our discretion, may determine a check to be ineligible for deposit using Mobile Deposit. You agree that you will not scan and attempt to deposit any of the following:

    • Checks payable to any person or entity other than you (i.e., third party checks; even if endorsed over to you);
    • Checks that are irregular in any way (for example, where the numerical and written amounts are different);
    • Checks payable to “Cash” or checks issued by you which are payable to you;
    • Checks containing alterations, illegible items, fraudulent checks, or checks that you should have known or have reason to believe were fraudulent;
    • Checks that have been previously deposited at another institution via physical item, image or electronic funds transfer;
    • Checks from financial institutions located outside of the United States;
    • Checks that are not payable in U.S. dollars;
    • Checks that are more than six (6) months old (i.e. stale-dated);
    • Checks that are post-dated, or payable on a date in the future;
    • Checks that exceed the deposit limits that we establish for Mobile Deposit;
    • Substitute Checks as defined by federal law (i.e. a digital reproduction of the front and back of an original check);
    • Demand drafts or remotely created checks (a check created by a merchant with a buyer’s checking account number on it, but without the original signature of the person authorizing the transaction);
    • Travelers checks and savings bonds;
    • Money orders;
    • Cashiers or Treasurers checks;
    • Non-negotiable instruments, such as promissory notes; or
    • Starter checks or counter checks (checks from a teller window).

      If we accept at times any of the items described above shall not obligate us to continue that practice, and we may stop doing so without cause or prior notice. Our failure to identify a Check Image you transmit as not being an Eligible Check shall not preclude or limit your obligations to us under this Agreement.

  10. Eligible Checks
    You agree that you will use Mobile Deposit to make deposits to your Checking Account only by transmitting to us Check Images of “Eligible Checks”. Eligible Checks are checks drawn on U.S. domiciled financial institutions in U.S. dollars that are:

    • payroll checks;
    • insurance agency checks;
    • rebate checks;
    • stock dividend checks;
    • checks issued by a business to you;
    • tax refund checks;
    • federal, state and municipal government checks; and
    • personal checks.

    Eligible Checks must also meet the following criteria:

    • the valid MICR number, check number and name of the payer are all commercially imprinted on the Original Check;
    • your signature (endorsement) is legibly written in ink on the Original Check along with the words: “For Mobile Deposit Only to Chime Checking Account” or in any other manner as instructed by Chime (if you are submitting a check made payable to you jointly with one or more person(s) (i.e., made out to “John Doe and Jane Doe”), it must be endorsed by all payees);
    • the check is submitted within six months (6) months of the check date;
    • the image quality must meet the standards established by the American National Standards Institute, the Board of Governors of the Federal Reserve, and any other regulatory agency, clearing house or association; and
    • the check does not contain erasures and was not altered.
  11. Receipt of Check
    Neither Chime nor the Bank is responsible for Check Images not received or dropped during transmission. We may refuse any check for depositing through Mobile Deposit, with or without cause, or may elect to take a check on a collection basis only. If we accept a check on a collection basis, we will not credit your account for the amount of the check until we receive the funds from the other institution. If we elect to credit your account before then, we will charge the amount back against your account if we do not receive payment for any reason. We may, at our sole discretion, represent any check that has been returned to us for insufficient funds without notice to you. A Check Image will be deemed received only when Chime provides you with Electronic Notice confirming receipt of the Check Image. After receipt of your Check Image is confirmed, the Check Image will be subject to review before it is submitted for deposit and may still be rejected for any reason at the discretion of Chime and the Bank. An Electronic Notice confirmation is not a representation, warranty or other indication that the Check Image will be presented for deposit or will be honored by any collecting or paying bank. If Chime or the Bank rejects a Check Image received through the Mobile Deposit feature, you may contact the individual or company who issued the check, to request a new or reissued check be provided to you. If you do submit the Original Check for processing, Chime and the Bank reserves the right to refuse to process it and may instead require you to have the check reissued.
  12. Retention of Original Check
    Once the funds from the Check Image have been credited to your Checking Account, you must mark the original check as “VOID” and retain it for sixty (60) days. You may not present the Original Check, or any Substitute Check created from the Original Check for payment at any other financial institution. During this sixty (60) day period, you must store the Original Check securely using precautions at least as secure as those you would use to protect a blank check. You must make the Original Check available to Chime or the Bank for review at any time during this sixty (60) day period as necessary to facilitate the clearing and deposit process, to address third-party claims or for our own audit purposes. Should you fail to produce the Original Check, you authorize Chime or the Bank to deduct the amount of the check in question from your Checking Account, regardless of whether such action may cause your Checking Account to not have sufficient funds. Immediately after this sixty (60) day period, you must securely and thoroughly destroy the Original Check.
  13. Endorsements
    You agree to ensure that all Eligible Checks transmitted through Mobile Deposit are made payable to you; and endorsed on the back with your signature and the words “For Mobile Deposit only to Chime Checking Account # XXXXXXXXXX” or as otherwise instructed by Chime. Any endorsement must be placed in the one-inch area starting at the left side on the back of an item and the remaining area on the back of the item may not contain any preprinted, stamped or handwritten information. Check Images we receive that are not endorsed in accordance with this provision may be rejected.
  14. Termination or Suspension of Mobile Deposit and Checking Account
    We reserve the right to suspend or terminate Mobile Deposit at any time without notice to you. We may suspend or terminate your use of Mobile Deposit at any time, with or without cause in our sole discretion. Any termination will not affect obligations arising prior to termination, such as the obligation to process Check Images transmitted to us prior to the termination date or your obligation to indemnify us. If you violate the terms of Mobile Deposit, such actions may be used as a basis to terminate your Checking Account.
  15. Your Representations and Warranties
    You represent and warrant the following with respect to each Check Image that you transmit through Mobile Deposit:

    • You have the legal right to accept the Original Check for negotiation and depositing to your Checking Account, and the Check Image is of an Eligible Check.
    • The Check Image that you transmit accurately represents all of the information on the front and back of the Original Check, including (without limitation) all endorsements, amounts, signatures required for their negotiation and endorsement, etc. at the time of transmission.
    • You are using Mobile Deposit only for your own deposits and have not allowed the use of the service for the benefit of any third party.
    • If you are depositing a check payable to you jointly, that each other payee has voluntarily and personally endorsed the original check and authorized you to deposit the funds into your Chime Account.
    • You have possession of each Original Check deposited using Mobile Deposit.
    • The information you provided for your Checking Account remains true and accurate; and, in the event any such information changes, you will immediately notify us of the change.
    • You make all warranties that would otherwise apply to the Original Check if it had been a paper item deposited with us. For example, you warrant that the Original Check has not been altered and that you have a right to enforce the Original Check (i.e. the Original Check was authorized by the drawer in the amount stated on the Original Check and to the payee stated on the Original Check).
    • You make all encoding, transfer, presentment, and other warranties that we or any correspondent bank we use are deemed to provide to others (e.g., as a reconverting bank) under any law, regulation, operating circular, clearinghouse rule, or image exchange network rule or agreement to which we or they are a party.
    • No Original Check will be presented for deposit or payment more than once. You have not previously cashed, deposited or transferred the Original Check, any image of the Original Check or any substitute check for the Original Check.
    • The Original Check is an Eligible Check.
    • You will only use Mobile Deposit for lawful purposes and in compliance with the online instructions and all applicable rules, law and regulations.
    • You will not submit files or images containing malicious code, viruses or any other disabling features that may have an adverse impact on our network, data, or related systems.
    • You have communicated material information to us.
  16. Returned Deposits
    Any credit to your account for checks deposited using Mobile Deposit is provisional. If a check deposited through Mobile Deposit is dishonored, rejected or otherwise returned unpaid by the drawee bank, or is rejected or returned by a clearing agent or collecting bank, for any reason, including, but not limited to, issues relating to the quality of the image, you agree that we may charge back the amount of the Original Check and send you notification of the return. You will reimburse us for all loss, cost, damage or expense caused by or relating to the processing of the returned item. We may debit any of your accounts to obtain payment for any item that has been rejected or returned, for any adjustment related to such item or for any warranty claim related to such item, whether or not the rejection, return, adjustment or warranty claim was made timely. If the maker of a check or another third party makes a claim against us or seeks a re-credit with respect to any check processed through Mobile Deposit, we may provisionally freeze or hold aside a like amount in your account pending our investigation and resolution of the claim.
  17. Limitation of Liability
    YOU AGREE THAT WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER LOSSES INCURRED BY YOU OR ANY THIRD PARTY ARISING FROM OR RELATED TO THE USE OF, INABILITY TO USE, OR THE TERMINATION OF THE USE OF MOBILE DEPOSIT, REGARDLESS OF THE FORM OF ACTION OR CLAIM (WHETHER CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE), EVEN IF WE HAVE BEEN INFORMED OF THE POSSIBILITY THEREOF, EXCEPT AS OTHERWISE REQUIRED BY LAW.
  18. Indemnification
    You will indemnify and hold us harmless against any and all actions, proceedings, liabilities, losses, costs (including attorneys’ fees), penalties, fines, and claims, including (without limitation) warranty claims, that result from or arise in connection with: (a) our processing of Check Images in accordance with this Agreement; (b) your actions or omissions, including your breach of any representation or warranty, or failure to comply with this Agreement; (c) any misuse of Mobile Deposit by you; (d) your failure to comply with applicable state and federal laws and regulations; (e) actions by third parties, such as the introduction of a virus, that delay, alter, or corrupt the transmission of Check Images or information to us; or (f) any claim by a recipient of a substitute check (corresponding to a check processed through Mobile Deposit) that the recipient incurred a loss due to (i) the receipt of a substitute check instead of the Original Check, or (ii) multiple payments with respect to the same Original Check, based on any combination of the Original Check, the substitute check, and/or any paper or electronic copy of either.
  19. Use of Your Geolocation
    When you are submitting an image for processing through Mobile Deposit, we reserve the right to, at our discretion, to use your mobile device’s capabilities to obtain your geolocation for fraud prevention services. We may choose to capture either your current location or the last location stored on your mobile device.

Fee Schedule

All fee amounts will be withdrawn from your Checking Account and will be assessed as long as there is a remaining balance in your Checking Account (except where prohibited by law. Any time your remaining balance is less than the fee amount being assessed, the balance of your Checking Account will be applied to the fee amount resulting in a zero balance on your Checking Account).

$2.50 (per transaction) out-of-network ATM withdrawal fee. No fee for transactions at any Allpoint® or Visa® Plus Alliance ATMs, or at MoneyPass® ATMs located in a 7-Eleven, Inc. location. MoneyPass ATMs not in a 7-Eleven, Inc. location will be subject to fee(s).

*If you use an ATM that is not a MoneyPass ATM in a 7-Eleven, Inc. location, an Allpoint ATM, or a Visa Plus Alliance ATM for any transaction, including a balance inquiry or cash withdrawal, you may be charged a fee by the ATM operator even if you do not complete a transaction. This ATM fee is a third-party fee amount assessed by the individual ATM operator only and is not assessed by us. This ATM fee amount will be charged to your Checking Account. Transactions at MoneyPass ATMs not in a 7-Eleven, Inc. location will be considered out-of-network and subject to the fee(s) as described above.

General Funds Availability

Information contained in this section is provided to assist you in understanding our Funds Availability Policy. All deposits into accounts opened through the Bank are processed at a Bank processing facility. This policy does not apply to checks deposited through the Mobile Deposit feature. For Mobile Deposit Funds availability, see section IV, “MOBILE CHECK DEPOSIT” 8 “Limits and Funds Availability”.

We make funds available according to the type of deposit and when the funds are applied or credited to your Checking Account. Some types of deposits may not be available for immediate use. When we delay the availability of funds or place a hold on a deposit made to your Checking Account, you may not withdraw those funds, and we will not use them to pay any debits, such as ACH transfers or payments, Checkbook transactions or transactions using your Card during the hold period. We have the right to refuse any deposit.

NOTE: If you are participating in the automatic transfers as set forth in Section C above, you acknowledge and agree that Eligible Deposits (as defined in Section C above) will be transferred to and subject to the terms governing the Secured Deposit Account.

If final payment is not received on any item you have deposited into your Checking Account, or if any direct deposit, ACH transfer credit is returned to us for any reason, you agree to pay us the amount of the returned item.

  • Availability
    The length of the delay in the availability of funds varies depending on the type of deposit.
  • Business Days
    The length of the delay in the availability of funds is counted in business days from the day your deposit is applied to your Checking Account. For purposes of these disclosures, our business days are Monday through Friday. Federal holidays are not included. Deposits received by midnight Mountain Time will be considered current-day deposits. Any deposits received after that time will be processed the following business day.
  • Same Day Availability
    Funds received from preauthorized electronic payments such as payroll direct deposits, or other preauthorized electronic payments will be available on the same business day the deposit is applied to your Checking Account.
    ACH Credits received from an external bank account will be applied to the Checking Account when we have verified the external account and received payment on collected funds. Once the funds are applied to the Checking Account, if received on a business day, they will have same day availability.
  • Longer Availability
    Electronic transfers depositing into the Checking Account initiated through the Chime Mobile App or Website may take up to five (5) business days from the date of the initial request but will post on the payment date of the deposit once the money has reached the Bank and/or Chime.

Chime Mobile Application Terms & Conditions
Please read the following terms and conditions very carefully. If you do not agree with the following terms and conditions, do not download or install this software. By downloading, installing or using this software or any portion thereof, you agree to the following terms and conditions.

  1. Use of the Chime Mobile Application
    This agreement (“Terms”) is entered into between you and 1debit, Inc. dba Chime (“Chime”), the program partner responsible for managing the Chime Checking Account (“Chime”). Subject to the provisions of these Terms, you are hereby granted the non-transferable right to use this software (“Chime Mobile App”) solely for personal, non-commercial purposes. You may not use the Chime Mobile App in any manner that may impair, overburden, damage, disable or otherwise compromise (i) Chime’s services; (ii) any other party’s use and enjoyment of Chime’s services; or (iii) the services and products of any third parties including, without limitation, any device through which you access the Chime Mobile App (the “Authorized Device”). You agree to comply with all local laws and regulations governing the downloading, installation and/or use of the Chime Mobile App, including, without limitation, any usage rules set forth in the online application store terms of service. From time to time, Chime may automatically check the version of Chime Mobile App installed on the Authorized Device and, if applicable, provide updates for the Chime Mobile App (“Updates”). Updates may contain, without limitation, bug fixes, patches, enhanced functionality, plug-ins and new versions of the Chime Mobile App. By installing the Chime Mobile App, you authorize the automatic download and installation of Updates and agree to download and install Updates manually if necessary. Your use of the Chime Mobile App and Updates will be governed by these Terms (as amended by any terms and conditions that may be provided with Updates). Chime reserves the right to temporarily disable or permanently discontinue any and all functionality of the Chime Mobile App at any time without notice and with no liability to you. For the avoidance of doubt, agreement to these Terms is solely between Chime and you. If you need to contact Chime about the Chime Mobile App, you may do so by calling (844) 244-6363.
  2. Privacy Policy
    As a condition of using the Chime Mobile App, you acknowledge that additional agreements may be in place that govern your relationship with Chime, including but not limited to the Chime Deposit Account Agreement, Chime Privacy Policy, the Chime User Agreement, the Stride and/or Bancorp Consumer Privacy Notice(s), and the Electronic Communication Agreement, each of which is hereby incorporated by reference (collectively referred to as “Chime Agreements”). You acknowledge and agree that Chime Agreements may be updated from time to time, without prior notice. Any such change(s) will be effective as soon as Chime posts a revised version of that Chime Agreement. In the event of an otherwise irreconcilable conflict between these Terms and Chime Agreements, these Terms will govern, solely with regard to the conflicting provisions and solely to the extent of such conflict. Chime may track and archive certain information regarding your use of the Chime Mobile App (“Use Information”). Use Information may be stored and processed in the United States or any other country in which Chime or its agents maintain facilities. By using the Chime Mobile App, you consent to the collection of your Use Information and to any transfer of your Use Information outside of your country.
  3. Proprietary Rights
    You hereby acknowledge that Chime owns all rights, titles, and interest in and to the Chime Mobile App and to any and all proprietary and confidential information contained therein (“Chime Information”). The Chime Mobile App and Chime Information are protected by applicable intellectual property and other laws, including patent law, copyright law, trade secret law, trademark law, unfair competition law, and any and all other proprietary rights, and any and all applications, renewals, extensions and restorations thereof, now or hereafter in force and effect worldwide. You agree that you will not (and will not allow any third party to) (i) modify, adapt, translate, prepare derivative works from, decompile, reverse engineer or disassemble the Chime Mobile App or otherwise attempt to derive source code from the Chime Mobile App; (ii) copy, distribute, transfer, sell or license the Chime Mobile App; (iii) transfer the Chime Mobile App to, or use the Chime Mobile App on, a device other than the Authorized Device; (iv) take any action to circumvent, compromise or defeat any security measures implemented in the Chime Mobile App; (v) use the Chime Mobile App to access, copy, transfer, retransmit or transcode Content (as defined below) or any other content in violation of any law or third party rights; (vi) remove, obscure, or alter Chime’s (or any third party’s) copyright notices, trademarks, or other proprietary rights notices affixed to or contained within or accessed through the Chime Mobile App.Content made available through the Chime Mobile App (“Content”) is protected by applicable intellectual property rights and is the property of Chime, its third-party licensors and partners (as applicable), and other entities that provide such content to Chime. You may not (or enable others to) copy, distribute, display, modify, or otherwise use the Content except as it is provided to you through the Chime Mobile App hereunder. Chime and its licensors make no representations or warranties regarding the accuracy or completeness of the Content.
  4. Export Restrictions
    Chime does not represent that the Chime Mobile App is appropriate or available for use in any geographical location. Any entity choosing to use the Chime Mobile App is solely responsible for compliance with all applicable laws. The Chime Mobile App is subject to U.S. export controls and may not be downloaded, exported or re-exported: (i) into any country with respect to which the United States maintains trade sanctions prohibiting the shipment of goods; or (ii) to anyone on or acting on behalf of an entity on the U.S. Treasury Department’s list of Specially Designated Nationals and Blocked Persons or the U.S. Commerce Department’s Denied Persons List or Entities List or included in General Order 3 (15 C.F.R. Part 736, Supplement 1), which prohibits exports to Mayrow General Trading, affiliated entities and persons, and specified persons involved in the manufacture or sale of Improvised Explosive Devices (together referred to as “U.S. Prohibited Party Lists”). By downloading and/or using the Chime Mobile App, you represent and warrant that you are not (a) located in or a national or resident of any country noted above or any country that is subject to U.S. trade sanctions, or (b) on any U.S. Prohibited Party List or acting on behalf of any person or entity on any such list.
  5. Termination
    You may terminate acceptance of these Terms at any time by permanently deleting the Chime Mobile App in its entirety from the Authorized Device, whereupon (and without notice from Chime) any rights granted to you herein will automatically terminate. If you fail to comply with any provision of these Terms, any rights granted to you herein will automatically terminate. In the event of such termination, you must immediately delete the Chime Mobile App from the Authorized Device.
  6. Indemnity
    You agree to indemnify and hold harmless Chime and its subsidiaries, affiliates, officers, agents, and employees (and their subsidiaries, affiliates, officers, agents, and employees) against any and all claims, suits or actions arising from or in any way related to your use of the Chime Mobile App or these Terms, including any liability or expense arising from all claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees, of every kind and nature. In such a case, Chime will provide you with written notice of such claim, suit or action.
  1. Entire Agreement; Revisions to Terms
    Chime may, from time to time, modify these Terms. Such modifications shall be effective as soon as the modified version of the “Chime Mobile Terms of Use” is posted in the online application store or any other authorized Chime Mobile App distribution location. You can determine when these Terms were last revised by referring to the “LAST UPDATED” legend at the top of then-current version of the “Chime Mobile Terms of Use” in the online application store or any other authorized Chime Mobile App distribution location. Your use of the Chime Mobile App following such changes constitutes your acceptance of the revised version of the “Chime Mobile Terms of Use” in the online application store or any other authorized Chime Mobile App distribution location.
